CONDITIONS 2007 -

Covering Hand
Picked and Consol Nishikigoi purchasefs in Japan with JKX
1. By
placing an order with or buying fish from JKX you agree to be bound by our terms
and conditions.
2. All
orders must reach us at least 7 days before shipment; this is required by
Japanese Government Health Certificate Department.
3. Orders
can not be added to or changed after this 7 day period.
4. All
prices quoted are in Japanese yen.
5. Any
prices quoted in other currencies are approximate only.
6. All
koi remain the property of the breeders or JKX until paid for in full.
7. All payments must be made in
Japanese yen to our account in the
United Kingdom or Japan.
8. Payments
must be made before shipment or unless otherwise agreed in the time scale
discussed.
9. Final
Consol prices will include total fish and freight cost in yen. A ¥ 3,000 per box
charge will be added to each order (this
includes hand buying trips) for internal transport costs and health certification in Japan.
10. Freight cost covers most destinations in the world but if
additional charges are required you will be informed and charged for these.
Freight charges may change during the season; you will be informed if this
happens.
11. For Hand picked koi, prices charged are for koi only, freight and
other costs (3000 per box charge ) will be added as agreed at
the time.
12. Final invoice prices are to destination only, all clearance costs
and taxes at destination are customerfs responsibility.
13. Prices may change without notice, but when possible these changes
will be notified.
14. Fish numbers in box may change without notice. The quantity
indicated on the price list is generally the correct one. However JKX reserves
the right to change the quantity, particularly during hot weather for the well
being of the fish.
15. A small charge for dry ice may be added in hot weather.
16. All fish sizes quoted are in CM and approximate and are measured
from head to tip of tail.
17. All mixes of fish listed in the price list are correct to the
best of our knowledge. During the season mixes may vary subject to availability.
18. By placing an order with or buying fish from the breeders via JKX
you agree that you understand that fish purchased from the breeders via JKX are
done entirely at your own risk. And that JKX can in no way be held responsible
for the health of the fish once you have purchased them in Japan, during
shipping or at their final destination, or for the health of existing stocks you
may have.
19. All fish are sold as seen and whilst every effort is made to
provide healthy fish, the health of hand picked or console fish can not be
guaranteed.
20. JKX recommends isolating new arrivals from existing stocks in
separate systems for an adequate period of time.
21. Consol codes ordered which are out of stock will be replaced with
an alternative unless other wise informed.
22. D.O.A (Dead on arrival). Claims must be made within 24 hours of
the fishfs arrival by fax. Claims will only be accepted for fish value and not
the freight costs. Claims of less than 10% of total fish value will not be
considered.
23. JKX can not be held responsible for claims beyond 24 hours and
accept no responsibility for loss of fish beyond this point either to new
arrivals or existing stocks.
24. Dead fish should be photographed and kept until discussed with a
member of JKX.@Failure
to do this will void the claim.
25. JKX can not guarantee claims as this must be negotiated with each
breeder and it will be the breederfs decision if he replaces the claim. If
agreed claims will be replaced with fish to the same value and shipped at
customers cost on the next available shipment.
26. On arrival shipments of fish may appear stressed (they have
traveled up to 9000 km) and may be lying down in
the box. The water
has been chilled to ease their journey and at a glance may appear motionless
27. Please insure the correct arrival
procedures for your fish to insure a good recovery from their shipment time. JKX
can supply you with recommendations for this.
